3 Reasons a Judge Might Deny You Bail

Bail is not guaranteed. A judge looks at the charge, the person’s history, and whether they are likely to come back to court. These are three situations that often lead a judge to deny bail or set conditions that are hard to meet.

Immigration status and an ICE hold

Citizenship by itself does not automatically cancel bail in a Georgia court. A judge can decide that someone who may leave the country is a flight risk. Immigration and Customs Enforcement can also place a separate hold that the jail has to honor. If that is the situation, call us with the county and the charge. We will tell you what we can see and what we can post.

Flight risk

A flight risk is someone the judge believes is likely to miss court. That finding can mean no bail, or bail with conditions that are difficult to meet. The next step is to read the actual order and talk with the lawyer on the case. Call us if you have the jail and the booking information. We will tell you whether a bond can be posted.

A repeat or violent record

A prior record, especially for similar or violent charges, can lead the judge to deny bail or set it higher. It is not automatic in every case. The charge, the history, and the county all matter. If bail is set, the premium with Anytime Bail Bonding is up to 15% of the bail and is not refundable.
